Terms of Service

1. Agreement to Terms

By accessing or using Hey Codex ("the Service"), operated by Tejeshwar ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

The Service includes the Hey Codex iOS application, the companion watchOS application, the custom keyboard extension, and the website at appex.app.

2. Description of Service

Hey Codex is an AI-powered audio transcription and insight generation platform. The Service allows you to:

• Record and upload audio for transcription.
• Receive AI-generated summaries, action items, decisions, and other insights from your recordings.
• Create, edit, and sync notes across devices.
• Use AI-powered text tools (rewrite, translate, adjust tone, expand, continue) via the custom keyboard extension.
• Share transcriptions and insights via public links.

3. Accounts

To use the Service, you must create an account using an email address and password, or via Google OAuth. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must be at least 13 years of age to use the Service. By creating an account, you represent that you meet this age requirement.

4. Subscriptions and Billing

Hey Codex offers a free tier with up to 5 transcriptions per month. For additional usage, a Pro subscription is available:

• Monthly: $9.99/month
• Annual: $99.99/year

Pro subscriptions include a 3-day free trial. Subscriptions are billed through Apple App Store and managed via RevenueCat. Payment is charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.

Refunds are handled by Apple in accordance with their App Store policies. We do not process refunds directly.

5. Your Content

You retain ownership of all audio recordings, transcriptions, notes, and other content you create or upload to the Service ("Your Content"). By using the Service, you grant us a limited license to process, store, and transmit Your Content solely for the purpose of providing and improving the Service.

You are responsible for Your Content and must ensure you have the necessary rights and permissions to record, upload, and share it. Do not upload content that is illegal, harmful, or infringes on the rights of others.

6. AI Processing

The Service uses third-party AI providers to process your audio and text:

• Google Gemini 2.5 Pro is our primary AI provider for audio transcription and insight generation.
• AssemblyAI is used as a fallback transcription provider.

Audio and text sent to these providers are processed according to their respective terms of service and privacy policies. We do not use your content to train AI models. AI-generated outputs (transcriptions, summaries, insights) may contain inaccuracies. You are responsible for reviewing and verifying AI-generated content before relying on it.

7. Shared Documents

When you share a recording, the transcription, insights, and optionally the audio file become accessible to anyone with the share link. Share links use UUID-based access and do not require the recipient to have an account.

You are responsible for the content you share and who you share it with. You can deactivate any share link at any time. Once shared, recipients may have already downloaded or copied the content.

8. Custom Keyboard Extension

The Hey Codex keyboard extension requires Full Access to communicate with our servers for AI text processing. The keyboard only sends text to our servers when you explicitly invoke an AI action. We do not log keystrokes, collect typing patterns, or access content in password fields.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to record others without their consent where required by law.
• Attempt to gain unauthorized access to the Service or other users' accounts or data.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to generate spam, phishing content, or other abusive material.
• Exceed reasonable usage limits or abuse the free tier to circumvent subscription requirements.

We reserve the right to suspend or terminate accounts that violate these terms.

10. Data Storage and Security

Your audio files are stored on Cloudflare R2 cloud storage. Account data and metadata are stored using Supabase (built on PostgreSQL). All data in transit is encrypted via TLS. We implement row-level security to ensure you can only access your own data.

While we take reasonable measures to protect your data, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security.

11. Termination

You may delete your account at any time. Upon account deletion, all your data (recordings, transcriptions, notes, and insights) will be permanently deleted.

We may suspend or terminate your access to the Service at any time for violations of these terms, with or without notice. If you have an active subscription at the time of termination for cause, no refund will be provided.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose.

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Changes to Terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised terms. For significant changes, we will make reasonable efforts to notify you via email or in-app notification.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.
